Terms and Conditions – Nova Manchester

1. Definitions

In these Terms and Conditions, the following terms are defined as follows:

“We”, “our”, “us” refer to Nova Manchester.
“Customer”, “you”, “your” refer to any individual or entity making a purchase through our website.
“Product(s)” refer to the goods and services offered by Nova Manchester.
“Website” refers to our online presence via www.novamanchester.com.
“Nova Manchester” also refers to the company operating under this name, registered with the Dutch Chamber of Commerce (KvK) under number 94673918.

2. Scope

These Terms and Conditions apply to all offers, orders, deliveries, and agreements made between Nova Manchester and the customer, unless otherwise agreed in writing.

By accessing our website and/or making a purchase, you agree to these terms, including all referenced policies and provisions.
These terms apply to all users, whether or not a purchase is completed.

3. Offers and Orders

All our offers are non-binding, unless explicitly stated otherwise.
An order is considered accepted once confirmed in writing by Nova Manchester or upon shipment of the products.
Once validated, an order cannot be canceled.

4. Prices and Payment

All prices are listed in euros (€) and are exclusive of taxes unless stated otherwise.
In the case of promotional offers (e.g., free shipping), Nova Manchester will cover the applicable costs.
Payment must be made within the timeframe indicated on the invoice, unless otherwise agreed in writing.

5. Delivery

Products are delivered to the address provided at the time of ordering, unless otherwise agreed.
Delivery times are estimates only. Any delay shall not entitle the customer to cancel the order or claim compensation.

6. Returns and Claims

Any claim regarding a delivered product must be made in writing within 7 days of receipt.
Returns are accepted only if products are unused and in their original packaging.
Return costs are the responsibility of the customer, except in the case of an error made by Nova Manchester.

7. Liability

Nova Manchester shall not be held liable for any direct or indirect damages resulting from the use of its products, except in cases of gross negligence or willful misconduct.
Allergies or sensitivities related to materials or components used in products shall not result in liability if such information is correctly provided in the product description.

8. Intellectual Property

All intellectual property rights, including designs, text, images, and visuals displayed on the website or associated with products, are the exclusive property of Nova Manchester.
Any reproduction, distribution, or use without prior written consent is strictly prohibited.

9. Force Majeure

Nova Manchester shall not be held responsible for failure to perform obligations due to circumstances beyond its control (e.g., natural disasters, strikes, technical failures).

10. Governing Law

These Terms and Conditions, as well as any contracts or disputes between Nova Manchester and the customer, are governed by Dutch law.
